HAWAII FITNESS SUPPLY — RELEASE OF LIABILITY & ASSUMPTION OF RISK

By accepting delivery of any equipment package from Hawaii Fitness Supply ("the Company"), the customer acknowledges, understands, and agrees to the following:

  1. Condition of Delivery. All equipment is delivered in crates as individual components requiring assembly and installation. The Company delivers products in this form only and is not responsible for assembly, installation, or mounting of any unit.
  2. Customer Responsibility. It is the sole responsibility of the customer to assemble all equipment correctly and to securely anchor and install each unit into concrete, wall studs, or other appropriate structures, as specified for that particular unit. Proper assembly and secure installation are essential to safe operation and damage/injury prevention.
  3. Use of a Licensed Contractor. The Company strongly recommends that the customer hire a licensed, qualified contractor to perform or verify all installation and anchoring work. This ensures each unit is properly secured to the floor, wall, or other structure and meets applicable safety and building requirements.
  4. Assumption of Risk. The customer understands that improper assembly or installation can result in equipment failure, tipping, collapse, or detachment, which may cause serious injury, death, or property damage. The customer voluntarily assumes all risks associated with the assembly, installation, and use of the equipment.
  5. Release of Liability. The customer hereby releases, waives, and discharges Hawaii Fitness Supply, its owners, employees, and agents from any and all liability, claims, demands, damages, or causes of action of any kind arising from or related to the assembly, installation, securing, or use of the equipment — including, without limitation, any damage to property or injury to persons.
  6. No Warranty of Installation. The Company makes no representation or warranty regarding the safety, stability, or fitness of any unit once it has left the Company's possession. Responsibility for safe and proper installation rests entirely with the customer.
  7. Indemnification. The customer agrees to indemnify and hold harmless Hawaii Fitness Supply from any claims, losses, or expenses (including legal fees) brought by the customer or any third party arising out of the assembly, installation, or use of the equipment.

By accepting delivery, the customer acknowledges they have read, understood, and agreed to this release of liability.
